  Notes	While there is no concrete proof that this Joseph Austin is the sonof Bartholomew and Elizabeth, the secondary evidence regarding thearea where he lived (same as Davis), his relationship to BartholomewBusby and his approximate date of birth lead me to believe that hemust have been their son. Joseph Austin is listed on the roster of the Fairfield/Craven CountyLoyalist Regiment of Col. Robert Winn during the Revolution. There areno records of his having owned land in Fairfield County In a premarital agreement between Joseph Austin and Sarah Ann Hinsonin Liberty Co. Deed Book D, page 68-70, they agree that Sarah owns 23slaves in her own right and that she shall not be liable for any ofJoseph's debts. Dated October 14, 1796. Then, on the next day (theday of their wedding) they sell all 23 slaves to William Moore andDaniel Stewart. Joseph's will is recorded in Book B, Liberty Co., pages 71-72. In ithe leaves several slaves and his young horse "Liverpool" to his sonJoseph. His dwelling house is to be shared by wife (second wife, Mary)and her sister, Fanny Valley. He states that his wife has been amplyprovided for by a marriage settlement. His nephew Bartholomew A.Busby is to receive 105 acres of land; daughter Abigail King is toreceive four slaves, the last three "by virtue of my former wife'swill, being the issue of a wench named Sylvia." He also leaves twoslaves to Abiel Winn, the son of Peter Farley Winn. (Joseph was AbielWinn's guardian, although the wording in the documents referring tothis relationship indicates that Peter Winn was still alive.) Joseph was a private in Troop H of the Liberty Blues, Regt. M in July1800. On April 20, 1807 in Liberty Co. Deed Book F, page 172, Josephgave his power of attorney to John J. Peacock and Francis Lewis, histrusty friends, to act in his absence, dispose of property, notes,etc. This was a year before the probate of the estate of his wifeSarah. (Could they have gone back to SC for a time? This wouldexplain why Joseph, Jr. stated on census records that he was born inSouth Carolina.) Joseph had to have been married prior to marrying Sarah due to thebirth date of his daughter. Note, too, that Sarah makes no mention ofAbigail in her will, but that Joseph refers to his "former wife'swill" when referring to the slaves left to Abigail. According to a number of court documents that go back to as early as1828, it appears that Joseph was engaged in the buying and selling ofslaves.
